It was the first time that the leading multilateral banks had the opportunity to participate in this kind of debate with academics, policymakers and representatives of civil society organizations. The workshop was very useful in terms of the dissemination and increase awareness of the anti-corruption programs of the MDBs; the identification of how to engage the MDBs with respect to their anti-corruption programs. The panel established a good point of departure to be replicated in the future based on a rich discussion of preventive and proactive steps taken by the MDBs, including detailed implementation reviews, project procurement related audits. Practical matters such as the development of red flags matrices and involvement of integrity offices in project design in an effort to improve prevention of corruption were also included in the presentations. The workshop was an excellent instrument to share views on these issues from different perspectives and a space of dialogue and reflection to disseminate the results of the MDBs anti-corruption programs in close interaction with numerous stakeholders involved in this topic. The participation of the public was a key ingredient for the success of the debate due to the theoretical, practical and operational dimensions that were taken into consideration  Summary of presentations Enery Quinones, Chief Compliance Officer, European Bank for Reconstruction and Development (EBRD), explained the reason of the creation of the EBRD in light of the emergence of democratic freedoms and the rapidity of economic transformations that were instigated by the political changes in the last decade of the 20th Century, which saw the demise of communism as a political reality in Central and Eastern Europe. The Bank has assisted the transition to market economies based on the development of the private sector. This has also inadvertently created opportunities for illicit activity including bribes, kickbacks or payoffs. The EBRD has had to be attentive to this environment and has developed, over time, a coherent strategy for combating corruption, fraud, money-laundering and other such crimes or practices. The EBRDs constituent treaty requires it to take the necessary measures to ensure that the proceeds of any loan made, guaranteed or participated in by the Bank, or any equity investment, are used only for the purposes for which the loan or the equity investment was granted. She mentioned the establishment of a Joint International Financial Institution Anti-Corruption Task Force on February 18, 2006 by the leaders of the African Development Bank Group, Asian Development Bank, European Bank for Reconstruction and Development, European Investment Bank Group, International Monetary Fund, Inter-American Development Bank Group and the World Bank Group, to work towards a consistent and harmonized approach to combat corruption in the activities and operations of the member institutions, recognizing that a unified and coordinated approach is critical to the success of the shared effort to fight corruption and prevent it from undermining the effectiveness of their work. Furthermore Mrs. Quinones prcised that the EBRD relies primarily on its robust ex ante measures, particularly its integrity due diligence procedures prior to undertaking an investment decision, in order to avoid corruption and fraud in its operations.  Jan Willem van der Kaaij, Inspector General, European Investment Bank presented the main policy initiatives of his institution. The EIB is making major progress on a number of important fraud and corruption-related topics. In April 2008, the Board adopted the EIBs Anti-Fraud Policy after two rounds of public consultation with interested parties including NGOs, TI etc. EIB is committed to putting in place a workable sanctions policy and recognises the important role that an effective sanctions process can have in (i) deterring fraud and corruption and (ii) holding entities accountable for their misconduct. A working group (from EIB) is in contact with the Commission to discuss various issues arising out of the new Early Warning and Exclusion System (EWS). He accounted the EIB is developing a proactive investigation programme to ensure that the Bank is not only reacting to reported allegations but under the new programme will also pro-actively assess the risks posed to the Banks activities and operations by fraud and corruption. In addition, EIB will continue to work in close cooperation with OLAF, its primary focus being lending to EU Member States. He observed the rising caseload. Overall it is still likely there is an under-reporting of issues (compared to size of the portfolio) which he expects to change in coming months. In conclusion, Mr. Van der Kaaij explained more remains to be done but EIB has made great strides over the last year or two. Its approach has demonstrated it is committed to the fight against fraud and corruption and it will work with civil society and other organisations to promote transparency and accountability. EIB will take firm action to pursue the zero tolerance approach, including making referrals to national law enforcement agencies and monitoring follow-up.  Philip Daltrup, Auditor General, Asian Development Bank explained that the ADB was an early adopter of governance and anti-corruption policies. An implementation review resulted in the Governance and Anticorruption Plan II in 2006. GACAP II has a strong focus on implementation and delivery of results, notably in the areas of public procurement, financial management and anti-corruption. ADB conducts institutional procurement and capacity assessments that feed into project selection and the design of project implementation arrangements. ADB assists borrowers to put together project procurement plans, and use the assessment and plans to determine the appropriate level of ADB fiduciary oversight and monitoring. ADB participated in drawing up the 2006 Uniform Framework and applies it in investigations of fraud and corruption. Misrepresentation, false claims, submission of false documents as examples of fraud in ADB-financed projects; collusion, bribery and extortion, abuse of position, kickbacks and theft/embezzlement as examples of corruption. Around half the tip-offs come from ADB staff, others from ADB audits, some from borrowers or civil society. With a very small team, remarkable success in processing and completing investigations in a timely fashion. ADBs aim is to convey that there is a credible threat of detection and enforcement. ADB does around six Project Procurement Related Audits (PPRAs) per year. This enables ADB to be pro-active, selecting projects for review rather than waiting for complaints. Very resource-intensive: ADB would like to do more, but can't with current resources. Project selection based in part on vulnerability assessment and experience with project implementation. ADB leads, but involves borrower's audit staff, generally from the country's supreme audit institution. Today, ADB is working on enhancement of existing whistleblower protection. Looking at better information sharing with development partners, but care needed over confidentiality issues. The desirability of expanding existing fraud awareness and integrity training for ADB and borrowers' staff is a priority.  Steve Zimmermann, Chief of the Office of Institutional Integrity, Inter-American Development Bank made a very practical presentation based on three cases investigated by his office. The first case involved a decentralized infrastructure project in which winning bidders had been found to pay kickbacks to local mayors and their political parties as well as losing bidders to ensure they were selected by local bid selection committees. The second case involved findings that a firm had created fictional employees to inflate reimbursements to the project and defraud taxing and social service agencies. The third case was based on composite findings in a number of investigations in which firms used Bank funds to pay for consultants but then obligated consultants to kickback a portion of their salary as a requirement of employment. The IDB has now had a sanctions process in place for two years and has a public listing on its website of firms and individuals that have been declared ineligible from receiving Bank funds. The IDBs integrity office, OII, has substantially expanded its prevention activities. In 2009 it will roll out a pilot of a web-based Red Flags Matrix designed to detect risks or indicators of corruption during project execution early enough to allow for mitigation before an investigation is required. OII is also partnering with operational offices within the IDB to identify and discuss integrity risks within specific sectors and geographic regions. Together, the teams work to identify mechanisms to mitigate the risks during both project design and execution. OIIs activities to encourage integrity in private sector lending operations were also highlighted. This work led to harmonization of integrity clauses in certain loan contracts. Eddie Ouko, Auditor General, African Development Bank declared that the Banks Anti Corruption Strategy consists of preventing corruption in the Bank operations, mainstreaming corruption concerns in its operations, assisting Regional Member Countries in capacity building, strengthening its institutional capacity in vigorously pursuing cases of corruption, and being active in regional Anti Corruption initiatives including close cooperation with sister institutions. Under the prevention measures the AfDB has reinforced the corruption clauses in its loan agreements and in contacts between Borrowers and Suppliers. It has also reinforced audit clauses in the agreements and contacts. The Bank has assisted more than 25 RMC in building their capacity to fight corruption and to improve Public Finance Management. The Integrity and Anti Corruption Division is undertaking sensitization program both within the Bank systematically through the Bank organizational clients and externally in Regional Member Countries, targeting in particular NGOs, Project Implementation Units and Executing Agencies. The Bank also has Internal Audit adapting their audit methodology (approach) to actively flag out suspicions of fraud and corruption in its operations. The Bank has strengthened its institutional capacity in pursuing cases of corruption and fully espoused the IFI uniform framework. The AfDB has incorporated the definitions under general conditions applicable to loans and guarantees agreements, incorporated the relevant guidelines in the standard operating procedures for the Integrity and Anti Corruption Division. He declared the Bank is conscious of fraud and corruption risks inherent in its strategy to decentralize, increased focus on infrastructure and private sector operations. An important pillar supporting the Banks investigation is the Banks Whistle blowing policy. The implementation of this policy has reached a maturity level where it i) now provides back bone to case load, and ii) has resulted in case of possible retaliation which is being actively investigated.  In his presentation, Howard Dean, Senior Policy Officer, Vice Presidency for Integrity, World Bank, discussed the historical development of the World Bank's anti-corruption movement. His presentation mainly focused on: (i) the watershed decision taken by the Bank in 1997 that it has a fiduciary obligation to ensure that its funds are not misused through fraud and corruption (and the reasons for that decision); (ii) the creation of an investigative function that, in 2001, became the Department of Institutional Integrity (INT); (iii) the resistance to INT by those in the Bank who were of the strong view that there should not be an investigative function (and the reasons therefore); (iv) the growing acceptance of INT in the Bank, together with both the creation and amendment of policies necessary to equip INT and the Bank to address fraud and corruption more effectively (e.g., the establishment of a sanctioning system, the development of policies in respect of witness confidentiality, the creation of a Voluntary Disclosure Program, the sharing of investigation reports, etc.); (v) the tools historically used by INT (such as Detailed Implementation Reviews) to assist the Bank in identifying the anatomy of corruption and to implement safeguards in project design; (vi) the recent and on-going implementation of the Governance and Anti-Corruption (GAC) strategy and the Volcker recommendations, resulting in greater integration of the work of INT (now known as the Integrity Vice Presidency) into the operations of the Bank -- which will better assist operational staff to mitigate risk in projects; and (vii) the continued growth of INT and its restructuring under its new Vice President, Leonard McCarthy, including the current structure, organization and work of INT in line with the GAC strategy and the Volcker recommendations, with an emphasis on greater collaboration with Bank operations.  Main Outputs There are essentially three main outputs originated in the dialogue around the panel. i) A clear message of unity and political will in the MDBs actions in the fight against corruption. Given the circumstances this is a fact and this should be the solid ground for more cooperation and more dialogue in the future. The issue is now one of the key mainstream activities of the international financial institutions and a great challenge for them. ii) A great sense of coordination and harmonization of definitions and procedural actions from the Banks with respect to their anticorruption programs. There are a lot of legal and technical issues to be dealt with in the future. There is also a sense that a common platform is being built in order to walk in the same direction. iii) The necessity for continuous joint actions by the MDBs, Governments and Civil Society in a multi-dimensional approach to these issues. The participation of different actors involved in different roles and institutions is the right road to be effective in the fight against fraud and corruption. The private sector should be a key partner for innovative approaches to prevent and control corruption.  Recommendations, Follow-up Actions From the presentations and the rich debate, there at least three main recommendations to be implemented by the different actors involved in the fight against fraud and corruption: i) Permanent dialogue among MDBs to continue working together to deal with new challenges. This is a moving target which requires a lot of creativity to confront new ways to elude the compliance of the law. ii) Creating mechanisms with civil society to share the views on these issues and have them on board as key partners for the success of the anti-corruption programs. There are no standard forms to establish this contact with civil society but it should an imperative element of the strategy at all the stages. iii) The system of red flag matrices was highlighted by many as one of the most important mechanisms to achieve results in the field of the anti-corruption programs. More should be done in this area in order to develop and refine even more this useful tool iv) Given the greater involvement with the private sector, it is essential to continue making all the efforts to ensure integrity in private sector lending activities, following for example the EBRD experience. This is a new line of work for MDBs and a good field to be innovating in preventing and controlling fraud and corruption.  Highlights There was a lively debate and a great involvement in the dialogue from different representatives of Civil Society Organizations (CSOs) showing a clear interest of CSOs to engage and interact in cooperation with MDBs with respect to their anti-corruption programs. Every participant found the workshop to be quite interesting and useful. Not only were there a great number of different and alternative views of the topic, but the workshop and the conference provided an unique opportunity to connect with colleagues from around the world from the public, private and civil society sectors. In terms of questions, it should be mentioned thebroad range of questions expressing interest in, amongst other things, the effectiveness of criminal referrals andinterest in sanctioning mechanisms. The idea of law enforcement and real prosecution was one reiterated by many participants.
